TERMS OF PAYMENT

The placement fee will be invoiced on the day that the candidate commences employment and the fee must be paid within:

  • Standard position (7 days of invoice)
  • Temporary Positions (2 days of invoice)
  • Fixed term Contract workers (7 days of invoice)
  • Head Hunting (7 days of invoice)

The guarantee is only valid if payment is made within the stipulated period.

The client agrees that interest shall be charged on any amount owing to Talent Professionals a rate equal to two percent over the prime rate, from the date the payment falls due in terms of this clause.

TERMS OF INTRODUCTION

The terms and conditions as contained in this document become binding to the employer upon interviewing a candidate introduced by Talent Professionals.

In the event of an applicant being employed or being offered and accepting any work through the employer for a period of 12 months after the initial introduction by Talent Professionals, irrespective of whether such introduction is direct or indirect, the employer will be liable to Talent Professionals for the full fee referred to in Clause 1.

GUARANTEES

The guarantee period under Fee Structure will cover the employer in the event of the incumbent leaving his employ for reasons other than unfair dismissal (in terms of the Labour Relations Act 66 of 1995), retrenchment, disability or death.

In the event of a replacement Talent Professionals will replace the incumbent free of charge with a new guarantee period as negotiated with the original incumbent being effective.

CONFIDENTIALITY

It is required and the employer agrees to maintain a high level of confidentiality with regards to all information pertaining to candidates being referred.

The employer agrees to maintain utmost confidentiality with regards to all information concerning applicants referred. The employer further agrees not to divulge any information regarding an applicant without the prior written consent of Talent Professionals.

Contact with the applicant and / or the applicant’s existing employer may only be made with the written consent of Talent Professionals and the applicant respectively.

LIABILITY

Neither the member/s of Talent Professionals nor its staff or representative/s will be held liable for any damage, loss or personal injury or property for whatsoever cause arising directly or indirectly from any act or omission of a candidate introduced by Talent Professionals nor for employers who omit to observe and abide by legislation as contained in the Labour Relations Act 66 of 1995.

GENERAL

The Terms and Conditions as contained herein constitute the entire agreement between Talent Professionals and the employer and any variation thereto shall only be valid and binding on the parties by means of a duly signed addendum.
